By creating an account, purchasing credits, downloading leads, or otherwise using DailyLeadPro (the "Service"), you agree to be bound by these Terms. If you are using the Service on behalf of a business or other entity, you represent that you have authority to bind that entity, and "you" refers to that entity. If you do not agree to these Terms, you may not use the Service. In these Terms, "DailyLeadPro," "we," "us," and "our" refer to DailyLeadPro LLC.
All data provided through the Service is derived from public government records and publicly available APIs, including state Secretary of State and Division of Corporations business filings, county courthouse and recorder filings, county property and tax records, municipal open-data portals, the SBA, the CFPB HMDA database, USASpending.gov, federal court records, and the CMS National Provider Identifier registry. Where applicable, records may be enriched with contact information ("skip tracing") obtained from third-party data providers. DailyLeadPro LLC compiles and formats this public-record data; it does not represent that any record originated with DailyLeadPro LLC.
DailyLeadPro LLC is not a consumer reporting agency, and the data provided through the Service is not a "consumer report" as defined by the federal Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq. You agree that you will not use any data obtained from the Service, in whole or in part, for any of the following FCRA-regulated purposes:
By downloading or using any leads, you certify that you will use them solely for lawful business-to-business marketing purposes and not for any FCRA-regulated purpose.
You may use the data only for lawful business-to-business (B2B) marketing and outreach. You agree that you will not use the Service or any data obtained from it to:
You are solely responsible for ensuring that any telephone, text-message, fax, or email outreach you conduct using the data complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, the CAN-SPAM Act, and all state equivalents. Before contacting any individual, you are responsible for scrubbing your lists against the National Do Not Call (DNC) Registry, any applicable internal or state DNC lists, and for obtaining any consent required by law.
Where DailyLeadPro LLC provides DNC flags or line-status indicators, they are offered as a convenience only, are not guaranteed to be accurate or current, and do not relieve you of your independent obligation to verify compliance. DailyLeadPro LLC is not responsible for your communications with any individual or business.
The data is provided "as is" and "as available" from public sources. DailyLeadPro LLC makes no representation or warranty, express or implied, regarding the accuracy, completeness, timeliness, or fitness for a particular purpose of any data. Public records may be outdated, incomplete, or contain errors, and skip-traced contact information may be inaccurate. DailyLeadPro LLC is not responsible for any outdated, incomplete, or incorrect records, and disclaims all warranties to the fullest extent permitted by law.
DailyLeadPro LLC reserves the right, in its sole discretion and at any time, to refuse service, decline a sale, suspend, or terminate any account that it suspects of misusing the data, violating these Terms, or using the Service for any unlawful or FCRA-regulated purpose, with or without notice. We may request information about your intended use of the data as a condition of continued access.
You agree to indemnify, defend, and hold harmless DailyLeadPro LLC, its members, managers, officers, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the data or the Service, your violation of these Terms, or your violation of any law or the rights of any third party, including any claim under the FCRA, TCPA, CAN-SPAM, or any state privacy or consumer-protection law.
This Agreement shall be governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Broward County, Florida. The parties consent to personal jurisdiction in Florida.
